Drivers License Information If you took the breath test and blew .08 or above or if you refused the breath test, you will automatically lose your license.
These "administrative suspensions" will occur regardless of the outcome of your DUI case in court.
You do have the right to challenge these suspensions. This challenge is made during a "Formal Review Hearing" at the Department of Motor Vehicles (DMV).

If your breath test result is above the legal limit(.08) or you refused to provide a breath sample, the DUI citation you received will, in most cases, act as a 10-day driving permit. However, after this initial 10-day period, you will be subject to a 30 or 90 day "hard" suspension. The hard suspension means you will not be permitted to have a hardship or business license. YOU MUST ACT WITHIN 10 DAYS OF YOUR ARREST TO PRESERVE YOUR DRIVING PRIVILEGE.
