Florida Suspended Commercial Drives License Attorney

Florida Statute 322.64 states that any holder of a commercial drivers license (CDL) that is arrested for driving any vehicle while at or over the legal BAC limit, or who refuses to submit to alcohol testing, will result in mandatory disqualification of their CDL. Change in the duration of CDL disqualification

Under previous state laws a DUI or DWI for drunk driving in a commercial vehicle resulted in lifetime disqualification of your CDL in all offenses. Recent statute changes now mean a first offense DUI will result in disqualification from operating a commercial vehicle for one year or permanently if you have prior disqualifications if:

  • You were in actual physical control of a commercial vehicle or your personal vehicle with a blood-alcohol level or breath test result of .08 or higher
  • You have refused to submit to a breath, blood or urine test

Having your driver's license suspended — personal and CDL — means taking immediate action to preserve your commercial driving privileges. You must request a review by the department) within 10 days of your disqualification notice being issued.

The police must supply a notice of disqualification, your driver's license, sobriety test results, crash reports in a DUI accident, and all other evidence to the department within five days of issuance. Even if they fail, disqualification can still be considered and action taken.
